Passaic County Clear Criminal Record Lawyer
Q: Can I have more than one crime expunged?
A: No, you may only have one crime expunged.
Q: Do I have to tell people on job applications that I have had an expungement?
A: No. If you have had an expungement, you can treat your criminal history like it never happened. Only in select circumstances can an expunged record be disclosed.
Q: How long does an expungement take?
A: An expungement will take approximately 3 to 6 months.
Q: How will I know my records have been completely removed?
A: We confirm that the records have been removed with the New Jersey State Police Department. Once we receive written confirmation, we will send the notice to you.
Q: Do I need to go to court?
A: No. Only in rare cases do you need to appear.
Q: I would like to pursue an “Early Pathway” expungement. What do I need to know?
A: Please review New Jersey “Early Pathway” Expungement or call us at 973-540-0054 to discuss your matter.
Q: What if I do not disclose all of my previous offenses in the petition?
A: The county prosecutor will investigate your criminal background before he or she consents to the order. If you do not disclose all of your offenses, the prosecutor will detect them and the court will send your petition back for amending. If the non-disclosed offenses cause you to be ineligible, then your petition will be rejected.
Q: I have an out-of-state criminal record; can I still have my New Jersey record expunged?
A: Yes, but it depends on the nature of the out-of-state offense and the number and nature of your New Jersey offenses.
Q: I have an adult and juvenile record; can I have them both expunged?
A: Yes, but you must first expunge your juvenile record before your adult record. If you expunge your adult record first, you will be ineligible to expunge your juvenile record.
Q: What if I don’t remember all of my charges?
A: That’s okay. Just go to your local police department and request your criminal history. You will need to be fingerprinted and it may take a couple of weeks to receive. Once you have that, we can do the rest.
