An expungement is the removal and isolation of all criminal records on file within any court, detention center or correctional facility, law enforcement agency or juvenile justice agency regarding a person’s detection, apprehension, arrest, detention, trial, or disposition or adjudication of an offense within the criminal or juvenile justice system. The records will include complaints, warrants, commitments, processing records, fingerprints, photographs, index cards, “rap sheets” and judicial docket numbers. However, an Order for Expungement does not remove criminal records from private agencies, such as the Real Estate Commission or Department of Insurance. The court’s order will only affect organizations and agencies that are within its jurisdiction.
If an expungement is granted, the person can proceed with life as if the conviction or adjudication never happened. On job, school, housing and licensing applications, the person may legally state that he or she has never been arrested or convicted of a crime or disorderly persons offense. An expungement also grants an individual the ability to obtain a firearm ID card and prevents the forfeiture of pension.
Even though expunged records are isolated once they are removed, there are certain instances in which the records may be accessed:
- To set bail or determine sentencing for any subsequent arrest or conviction
- Used in consideration of PTI applications
- May be discoverable in civil proceedings
- Used in consideration when applying for law enforcement positions
- May be reviewed by the Violent Crimes Compensation Board (if a claim has been filed)
