Removal from NJ’s Megan’s Law:

In NJ, there are two statutory provisions that courts look at when deciding whether to remove a registrant from Megan’s Law.

N.J.S.A. 2C:7-2(f)

f. Except as provided in subsection g. of this section, a person required to register under this act may make application to the Superior Court of this State to terminate the obligation upon proof that the person has not committed an offense within 15 years following conviction or release from a correctional facility for any term of imprisonment imposed, whichever is later, and is not likely to pose a threat to the safety of others.

N.J.S.A. 2C:7-2(g)

g. A person required to register under this section who has been convicted of, adjudicated delinquent, or acquitted by reason of insanity for more than one sex offense as defined in subsection b. of this section or who has been convicted of, adjudicated delinquent, or acquitted by reason of insanity for aggravated sexual assault pursuant to subsection a. of N.J.S.2C:14-2 or sexual assault pursuant to paragraph (1) of subsection c. of N.J.S.2C:14-2 is not eligible under subsection f. of this section to make application to the Superior Court of this State to terminate the registration obligation.

Maynard Law Office, LLC Obtains Megan’s Law Removal for Clients

Despite the above statutory language, our specialized sex offense law firm has helped many clients get off sex offender registries.  For example, our law firm has obtained Megan’s Law removal for some clients who had a statutory bar to termination.  In other words, these individuals had multiple sex offense convictions, and some were even convicted of aggravated sexual assault.

In these cases, our law firm identified issues that other attorneys missed, or we asserted novel legal theories, grounded in law and empirical evidence, to obtain our client’s requested relief.

Recent Example of Legal Victory:

*C.M. was adjudicated delinquent of multiple sex offenses.  After his sex offense adjudication, C.M. had a Shoplifting adjudication.  The State opposed C.M.’s motion to terminate him from Megan’s Law.  The State argued that C.M. committed another “offense.”  Thus, the State argued that C.M. was not eligible to get off Megan’s Law.

Our firm argued that the State’s reasoning conflicted with the NJ Supreme Court’s landmark case, State in the Interest of C.K., 233 N.J. 44 (2018).  In C.K., the Court held that lifetime bars to termination for those adjudicated of sex offenses was unconstitutional.  Furthermore, our law firm litigated the C.K. case.

In C.M.’s case, the court agreed with our law firm’s position.  As a result, C.M. was successfully terminated from Megan’s Law.  Now, he no longer has to register as a sex offender in NJ.
