Consequences of PSL / CSL Violation:
A defendant’s violation will be dealt with based on whether the person is on CSL or PSL. For those on CSL, violations are heard in the trial court (criminal division) in the county in which the person was violated. Generally, PSL violations are heard by the NJ State Parole Board. However, they may also be prosecuted as a crime in court.
In PSL matters, the parole board has the authority to impose additional parole conditions or return the offender to prison. In contrast, in the case of a CSL violation, the registrant faces up to 18 months in prison unless a prison sentence would be a “manifest injustice.”
