Understanding New Jersey’s Updated Child Pornography Distribution Laws
New Jersey’s updated child pornography distribution laws increased the penalties for anyone who is convicted of distribution, as well as increased the scope of individuals who may face distribution charges.
Under the old laws, there was no mandatory minimum prison sentence. Under the new laws, a convicted individual faces least five years in a state prison. In addition, an individual could be sentenced to Parole Supervision for Life and will be required to comply with Megan’s Law registration.
The revised definition of distribution creates an umbrella effect, encompassing individuals who would have been previously charged with possession of child pornography, but now face much tougher charges and penalties. For instance, if an individual stored images on a file sharing program, he or she can be charged with distribution — even if the images were never shared.
Finally, when the laws were updated in 2013, the age of consent was increased to 18. As a result, if a minor is presumed to be under the age of 18, the images are considered child pornography.
