Sex Offense Attorneys
In February 2018, New Jersey revised its child porn laws — now, more individuals may face child porn charges. Among other changes, the meaning of “child pornography” has been expanded. Before, items were considered child porn if they depicted children engaging in sexual conduct. Now, child porn can mean an image of a child posing in a provocative way (even if not engaged in sexual conduct, and even if clothed).
Changes to the law mean that you need an experienced sex offense lawyer at the first sign of an investigation. At Maynard Law Office, LLC, we know that it can be embarrassing to ask for legal help during a sex crime investigation. However, it’s the only way to assure that your rights are PROTECTED. Our attorneys provide high-quality legal counsel to individuals in Morris County and throughout New Jersey.
NEW JERSEY’S UPDATED CHILD PORN DISTRIBUTION LAW
NJ’s updated child porn distribution laws have increased the severity of the punishment for those convicted of this offense.
- Under the old law, a conviction for this offense was a second-degree crime (up to 10 years in prison).
- Now, it is a first-degree offense (up to 20 years in prison) if a person is charged with distributing 1,000 or more items of child porn.
- If 1,000 or more items were involved, you can face at least 10 years in prison.
- Also, an individual could be sentenced to Parole Supervision for Life and will be required to register under Megan’s Law.
- Under the new law, each item of child porn in the form of a video, film, or movie, is counted as 10 separate items.
- As a result, those charged with distributing lots of videos or other visual depictions of child porn can face more severe charges.
