What is a “leader of a child pornography network”?

First, this new law makes it illegal for people to conspire with others to maintain or create a child porn distribution network. Someone who does not personally store files containing child porn may still be charged as the leader of a child porn network under this new law.
Second, the NJ Legislature also recently changed the meaning of the term “child pornography.” Before the revision, images were child porn if they depicted a child engaging in a sexual act, or in the simulation of such an act. Now, images showing children posed in provocative ways can be considered child porn, even if no sexual acts are depicted.
Lastly, the severity of the charges depends on the number of items of “child porn” involved. If 100,000 or more items of child porn are involved, it can be a first-degree crime. If at least 1,000 images but fewer than 100,000 images are involved, then it is a second-degree crime. Lastly, if less than 1,000 items were involved, it is a third-degree crime.
What Happens After Someone is Convicted as a Leader of a Child Porn Network?
The consequences one could face as a leader of a child porn network are serious.
- First, someone convicted of this crime will be put on New Jersey’s Megan’s Law.
- Next, others in the community may be notified that the person is on Megan’s Law.
- Finally, if convicted of this offense, the Prosecutor can make a motion to also impose Parole Supervision for Life (“PSL”).
